Whitney Law Group, LLC (“Whitney Law Group,” “the Firm,” “we,” “us,” or “our”) provides this website, https://whitneylawgroup.com, together with related online features, including contact forms, appointment scheduling, SMS/text messaging, and website chatbot functionality, subject to these Terms & Conditions (“Terms”). These Terms govern use of the website and related communications channels and clarify important legal disclaimers, including that no attorney-client relationship is formed unless and until the Firm expressly agrees in writing to represent a matter.

By accessing or using the website, submitting information through the website, using the AttorneyConnect AI chatbot, scheduling through Acuity Scheduling, communicating with the Firm by email, phone, voicemail, or SMS/text message, or otherwise interacting with Firm-operated online services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the website or any related online services.

An attorney-client relationship is created only if and when Whitney Law Group has completed its intake and conflict-review process and both the Firm and the client have entered into a written engagement agreement or other written fee agreement signed by the Firm. Until that occurs, the Firm has not agreed to represent any matter.

Because no attorney-client relationship is formed merely by sending information, you should avoid sending highly sensitive, confidential, or time-critical information through the website, chatbot, unencrypted email, voicemail, SMS/text message, or online scheduling/intake tools unless specifically instructed by the Firm to do so through a secure channel.

Whitney Law Group does not control third-party websites or services and is not responsible for their independent content, availability, or policies, except to the extent required by applicable law.

Scheduling and Intake Submissions

You may be asked to provide contact and intake information through Acuity Scheduling or other online forms in connection with requests for consultation or possible representation. Submission of scheduling or intake information helps the Firm evaluate and respond to inquiries, but does not obligate the Firm to provide services and does not create an attorney-client relationship.

The Firm reserves the right to decline any inquiry, decline any requested consultation, or decline representation for any lawful reason, including but not limited to conflicts of interest, subject matter, jurisdictional limitations, workload, or professional considerations.

SMS Terms

Consent to Receive SMS Messages

Whitney Law Group uses SMS/text messaging only for communications relating to legal services provided or potentially provided to clients and prospective clients, and not for marketing. By providing a mobile number through Acuity Scheduling, AttorneyConnect AI, other Firm forms, or by leaving a voicemail requesting contact, you agree that the Firm may send service-related text messages as permitted by applicable law and your consent.

You may opt in to receive SMS messages by: (1) submitting your phone number through Acuity Scheduling; (2) providing your phone number through AttorneyConnect AI; or (3) leaving a voicemail asking the Firm to contact you. The Firm may also use SMS to respond to a voicemail from a prospective client by directing that person to the Firm’s online scheduling portal to book a consultation.

Types of SMS Messages

If you consent to receive SMS messages from Whitney Law Group, those messages may include appointment reminders, scheduling links, consultation coordination, follow-up messages, billing or account-related messages, and case updates or other service-related communications. The Firm does not use SMS for marketing or promotional campaigns.

Message Frequency and Charges

Message frequency varies depending on your relationship with the Firm and the nature of your matter. Prospective clients typically receive 0-1 SMS messages per week, while onboarded clients who prefer texting may receive more frequent service-related messages as needed for representation-related communications. Message and data rates may apply depending on your mobile carrier plan.

Opt-Out and Help

You may opt out of SMS communications at any time by replying STOP to any message. For assistance, you may reply HELP or contact the Firm directly at 781-631-4400. Opting out of SMS will stop text messages to that number but will not necessarily prevent the Firm from contacting you by other reasonable means, such as phone or email, unless you separately request that limitation.

SMS Compliance and Disclosure

Whitney Law Group provides the option to receive text messages for appointment reminders and case updates. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The Firm may share SMS-related information with service providers solely as necessary to facilitate messaging services on the Firm’s behalf, subject to applicable confidentiality and processing restrictions. SMS consent records and phone numbers collected for SMS purposes are not shared with third parties or affiliates for their marketing use.

Privacy

Use of the website and related services is also subject to the Firm’s Privacy Policy, which describes how personal information may be collected, used, disclosed, and protected. In the event of a conflict between these Terms and the Privacy Policy regarding privacy practices, the Privacy Policy will control with respect to data handling, while these Terms will control with respect to website use and disclaimers.

No Warranty

The website and all content, tools, and communications made available through it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Whitney Law Group disclaims all warranties, including warranties of accuracy, completeness, timeliness, non-infringement, merchantability, and fitness for a particular purpose.

The Firm does not warrant that the website will be uninterrupted, secure, error-free, or free from viruses or other harmful components, or that defects will be corrected. You assume all responsibility for any reliance placed on website materials and for use of the website and related systems.

Limitation of Liability

To the fullest extent permitted by law, Whitney Law Group shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to use of, inability to use, or reliance on the website, chatbot, scheduling tools, SMS/text communications, linked resources, or any information provided through them, even if advised of the possibility of such damages.

Without limiting the foregoing, the Firm is not responsible for losses arising from missed deadlines, failed transmissions, delayed responses, technology outages, interception of communications, third-party platform failures, or your reliance on generalized website content, FAQs, or chatbot outputs.

Some jurisdictions may not allow certain warranty exclusions or liability limitations. In that event, those provisions apply only to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Whitney Law Group and its attorneys, employees, agents, contractors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your violation of these Terms, misuse of the website, unlawful submissions, or infringement of the rights of any person or entity.

Governing Law and Forum

These Terms and any dispute arising out of or relating to the website or related online services shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles, except to the extent superseded by applicable federal law. The existence of a satellite office in Portsmouth, New Hampshire does not alter this governing-law provision for website use unless otherwise required by non-waivable law.

Any action or proceeding arising out of or relating to these Terms, the website, or related online services shall be brought exclusively in the state courts of Massachusetts or the federal courts located in Massachusetts, and you consent to the personal jurisdiction and venue of those courts.

Changes to These Terms

Whitney Law Group may revise these Terms from time to time by posting updated Terms on the website. Changes become effective when posted, unless a later effective date is stated. Your continued use of the website or related online services after revised Terms are posted constitutes acceptance of the revised Terms.
